What Services Does Brian Smith Provide?

Probate Services

In my role as a probate lawyer, I typically review the Will of the Decedent with the Client and then make a proper determination of the heirs of the estate. I also determine the probateable assets of a Decedent’s Estate. A Probate Court action for the Estate is then filed in the County where the Decedent resided. As part of this probate action, a Personal Representative is appointed by the Court.

Letters of Administration are also issued by the Court which allow the Personal Representative to act on behalf of the Decedent’s Estate. Ultimately, an Order of Distribution is issued by the Probate Court which results in the proper distribution of the assets of the Estate to the appropriate heirs. I also ensure an Estate tax return, if required, is filed and any final tax returns for the Decedent are filed with the IRS.

Real Estate Services

As a real estate attorney, I review the purchase/sale contract with the Buyer or the Seller. I do a title review for Buyers to make sure the property at issue is free of all encumbrances, liens, code violations, and open permits. If required, I will take the necessary steps to clear the subject property of these issues. I prepare a closing statement for the transaction showing the proper allocation of the fees and costs allocated between the Buyer and the Seller. I also prepare, if necessary, the closing documents for the sale including the Warranty Deed, Bill of Sale, No-lien Affidavit, and any other documents required.

Ultimately, I coordinate the closing of the property with the Buyer, Seller, and their respective representatives. Finally, the Warranty Deed is recorded with the County Recorder’s office to effectuate a transfer of title. Title insurance is issued to the buyer, if appropriate, insuring his/her interest in the subject property. As part of my real estate practice, I also assist clients with property transfers through the use of quitclaim deeds and, in the appropriate circumstances, Lady Bird Deeds. Additionally, when clients need assistance with academic work or detailed reports, they sometimes turn to a reliable ghostwriter wien for professional support.

Eviction Services

I represent Landlords in eviction actions. In my role as an Tenant Eviction Attorney, I initially meet with the client and advise him/her of the pitfalls of an eviction action. I then assist in the preparation of a three-day notice and see that the notice is properly posted. If payment isn’t made after the posting of a three-day notice, I file an Eviction Action in the appropriate County Court requesting that the Landlord be placed back in possession of his or her property. If the Tenant files any pleadings or raises any defenses in the Eviction Lawsuit, I respond to these filings and if necessary, appear in court on behalf of the Landlord.

Then I obtain a Final Judgment and Writ of Possession from the Court and Clerk of Court, respectively, in favor of the Landlord. I follow up with the County Sheriff’s Office to ensure that the Writ of Possession is posted and acted upon by the Sheriff promptly. My Story

Hi, I am Brian Smith! I was born and raised in the Midwest. To this day, I retain my Midwest values: hard work, honesty, and respect for others. I attended the University of Wisconsin-Madison, where I obtained my Bachelor’s Degree in Accounting.  I then went on to obtain my Master’s in Business Administration at the University of Wisconsin. Following graduation, I worked at Arthur Anderson and Company in Chicago. After working at Arthur Anderson, I enrolled at Marquette Law School in Milwaukee Wisconsin where I obtained my law degree. Subsequently, I was employed at Deloitte and Touche in Miami, Florida where I was promoted to Tax Manager. I have been a licensed CPA in Florida since 1983 and a lawyer since 1986.

Ultimately, I struck out on my own and founded my own Law Firm: The Law Offices of Brian D Smith in Miami Beach, Florida in 1991. Recently, I moved to Hollywood, Florida, and also relocated my practice to Hollywood, Florida. Since establishing my own office, I have had the good fortune of dealing with a wide variety of diverse legal issues. Over time, I have limited my practice to Probate, Real Estate, and Eviction matters. My CPA background has been invaluable during the time I have practiced law.
